MENATA SISTEM PERWAKILAN DUA KAMAR (BICAMERAL SYSTEM) YANG EFEKTIF DI INDONESIA

Abstract

Abstrak

            Dewan Perwakilan Rakyat (DPD) adalah lembaga perwakilan yang lahir dari  amandemen ketiga atas UUD NRI 1945. Bersama DPR, DPD diharapkan menjadi salah satu kamar dari sistem parlemen dua kamar dalam format baru perwakilan di Indonesia. Realitas menunjukkan restrukturisasi parlemen atas kehendak UUD menciptkan tiga pilar utama dalam kamar legislasi di Indonesia yakni yakni MPR-DPR-DPD. Secara konstitusional MPR bersifat insidental, DPR bersifat legislatif, sedangkan DPD bersifat co-legislatif. Pelaksanaan peran ketiga  lembaga  parlemen  tersebut  menimbulkan  dinamika  yang  tidak  seimbang. Diskriminasi  peran,  fungsi  dan  kewenangan  dirasakan  sangat  mempengaruhi  kualitas legislatif  secara  umum.  Kesan bahwa DPD merupakan lembaga yang dibentuk setengah hati dalam gagasan parlemen semakin mencuat ditambah dengan pilihan sistem  soft  bicameralism telah  mengaburkan  sistem  parlemen  yang ada. Amanat  reformasi untuk mempercepat pembentukan sistem parlemen yang kuat dan berimbang tidak dapat terwujud  sebagai  konsekuensi  logis  dari  amandemen  konstitusi setengah  jadi. Penelitian ini mengunakan jenis penelitian normatif dengan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Penelitian yang berfokus utama pada data sekunder yakni  dengan teknik studi kepustakaan dengan mengolah data secara kualitatif. Hasil penelitian menunjukkan bahwa keberadaan DPD tidak efektif dan tidak efisien dalam mosaik ketatanegaraan Indonesia dan solusi atas permasalahan tersebut adalah dengan mengamendemen Pasal pengaturan DPD dalam UUD NRI 1945. Selama masih mempertahankan pengaturan DPD dalam UUD NRI 1945 maka DPD akan tetap mencerminkan parlemen Indonesia dengan sifat soft bicameralism walaupun disebut sebagai lembaga negaea tetapi kedudukan tetap saja tidak setaea dengan DPR.

Abstract

 

DPD (Senate) is a representative institution that was born since the third amendment to the 1945 Constitution of the Republic of Indonesia. Together with the DPR, the DPD is expected to become one of the chambers of the two-chamber parliament system in a new form of representation in Indonesia. The fact shows that the restructuring of the parliament based on the will of the constitution gave birth to three main pillars in the legislative assembly in Indonesia, namely the MPR-DPR-DPD. Constitutionally the MPR is incidental, the DPR is legislative, while the DPD is co-legislative. The implementation of the roles of the three parliamentary institutions creates an unbalanced dynamic. Discrimination in roles, functions and authorities is felt to greatly affect the quality of the legislature in general. The impression that the DPD as an institution formed half-heartedly in the idea of ​​a parliament is increasingly sticking, coupled with the choice of a soft bicameralism system, has obscured the existing parliamentary system. The reform mandate to accelerate the formation of a strong and balanced parliamentary system cannot be realized as a logical consequence of the semi-finished constitutional amendments. This research uses a type of normative research with a statutory approach and a conceptual approach. Research that focuses on secondary data, namely literature study techniques by processing data qualitatively. The results show that the existence of the DPD is ineffective and inefficient in the Indonesian constitutional mosaic and the solution is to change the Article of the DPD Regulations in the 1945 Constitution of the Republic of Indonesia. The lenient nature of bicameralism even though it is called a state institution, its position is still incompatible with the DPR.
